His
story
James
Rexford Powell (Rex) was born in Florida on August 23rd 1946. As an
adult, he remained some years out of work, after an accident with
his job.
Then
he started a new one that brought him to move from place to place by
a caravan. In those circumstances he met Falyssa Van Winkle, who was
the daughter of friends of him.
On
October 6th 1990 the girl was killed after being kidnapped and raped.
Rex was arrested and jailed. Eight months after he was sentenced to
death. His lawyers appointed by the Court did not offer a fair
defense to him, so many evidences that would show his innocence were
not rightly advanced or even introduced.
The
outcome of a DNA test on Rex was misrepresented by the prosecutors
in order to make him guilty. In the second phase of his trial, which
finished with Rex's sentencing to death, a previous judgment
undergone by him for another crime, that ended with his full
absolution, was used by the prosecutors as a proof of a possible
dangerousness of him.
The
state of Texas has scheduled for next October 1st the day of his
execution unless the Governor or the Commission of Board and Parole
won't halt it.
