BOBBY JAMES MOORE - (Texas � USA) 42 anni

Bobby James Moore ha 42 anni e da 22 si trova recluso nel braccio della morte in Texas dove attende una data di esecuzione. In questi lunghi anni ha percorso un profondo cammino spirituale e ha dimostrato un senso di equilibrio non comune, tanto che � stato definito un �prigioniero modello� dallo stesso personale carcerario.

Bobby, Afro-americano, proviene da una famiglia di 9 figli, con un padre alcolizzato che picchiava abitualmente sua madre e i suoi fratelli. A 14 anni, ancora analfabeta, venne da lui cacciato di casa per aver preso un giorno le difese della madre, divenendo quindi preda dei vari gruppi di ragazzi di strada che vivevano di furti e droga.

A 20 anni, nel corso di una rapina in cui aveva il compito di �palo�, una donna si mise a urlare improvvisamente, mentre suo marito si accasciava per terra. Preso dal panico, Bobby, che era armato, scivol� anche lui e nella caduta part� inavvertitamente un colpo dalla sua pistola che fer� mortalmente l�uomo.

Nel corso del processo, in cui Bobby si avvalse di un avvocato d�ufficio, non potendosi permettere un difensore esperto a causa delle sue povere condizioni economiche, nessuno credette che l�uccisione fosse stata accidentale e la giuria ratific� cos� la sua condanna a morte.

Durante la sua detenzione, Bobby ha imparato a leggere e a scrivere, sviluppando le sue capacit� in un ambiente che paradossalmente gli assicurava un pasto regolare, una cella, la possibilit� di fare ginnastica e di usufruire di servizi sanitari, cose che prima, da libero, non poteva concedersi. Successivamente si � dedicato a studiare diritto, per potersi aiutare nel processo che avrebbe dovuto affrontare.

Nel corso di questi 22 anni si � verificato un alternarsi di appelli i cui i giudici federali �non dipendenti da elezioni, in quanto incaricati a vita- dichiaravano che Bobby avesse diritto alla revisione del processo per come era stato condotto nel 1980, al contrario dei giudici statali che erano generalmente inclini alla condanna senza una seria presa in considerazione delle attenuanti, come la involontariet� del delitto e la condotta irreprensibile in carcere.

In particolare, un elemento molto utile a favore di Bobby, vale a dire la dinamica del colpo partito senza volerlo, non pot� essere utilizzato perch� l�arma dell�omicidio non � mai stata trovata.

Oggi Bobby spera di poter ottenere un nuovo processo, con un avvocato competente, ma il costo sar� assai sostenuto. Per questo in Gran Bretagna � stato costituito un comitato, per aiutare Bobby ad avere una difesa adeguata.

Bobby James Moore is waiting for an execution date. He is 42, and he has spent 22 years on death row. During this long time he has been undertaking a deeply spiritual path, showing an uncommon well-balanced mind, so that he was defined as an exemplary prisoner by the jail�s personnel.

Bobby is an Afro-American man coming from a family of 9 sons, with an alcoholic father who used to beat his wife and his children. When he was 14, being still illiterate, he was chased out of his house for having defended his mother against him, and then he joined to several groups of  street boys getting on with thefts and drug.

When he was 20, during a robbery while  he was on the lookout, a woman suddenly broke out screaming, while her husband was fainting down on the ground. Panic-stricken, Bobby, who got a revolver, slid down while a shot was inadvertently fired out of his weapon, wounding the man deadly.

At the trial his lawyer was appointed by the Court because he could not afford the the cost of a competent attorney. Nobody believed that the murder was accidental and the jury sentenced him to death.

In prison Bobby learnt to read and to write and developed his capabilities, in spite of that place was a death row.

He started to study law and tried to understand and prepare better for the new trial.

During these 22 years he presented several appeals and some judges �not particularly committed into the political life, declared that Bobby had the right to obtain a new trial.

Yet as the the state judges were inclined to sentence him to death, they did not consider other circumstances, such as his  unintentional will  to kill and his good behaviour in prison.

But the gun was never found.

Today Bobby wants a new trial, with a competent defending counsel, even if he knows it is expensive.
